Welcome to Ela Atelier. These Terms of Service govern your use of our website and your purchase of products and services from Ela Atelier. By accessing our website, placing an order, submitting a deposit, or approving a custom design, you agree to these Terms of Service.

Products & Services

Ela Atelier offers fine jewelry, custom jewelry, made-to-order pieces, and related design services. Product descriptions, photographs, renderings, measurements, and specifications are provided as accurately as possible.

Because jewelry is individually manufactured and gemstones may have unique characteristics, slight variations in appearance, dimensions, color, proportions, or finish may occur.

Custom & Made-to-Order Jewelry

Custom pieces are created according to specifications approved by the client, which may include design, metal, stone selection, dimensions, sizing, engraving, and other details.

CADs and digital renderings are intended to represent the design and proportions of a piece but are not exact photographs of the finished jewelry.

Once you approve a design and production begins, changes or cancellations may no longer be possible. If a requested change can be accommodated, additional design, material, or production fees may apply.

Design Deposits

A deposit may be required before beginning the custom design or CAD process.

Design/CAD deposits are non-refundable once design work has begun. When specified, the deposit will be credited toward the final purchase price.

Additional revisions or a significant change in design direction may require an additional fee.

Pricing & Payment

All prices are displayed or quoted in U.S. Dollars (USD) unless otherwise stated.

Custom quotations are based on the specifications provided at the time of the quote. Pricing may change if the client requests changes to the design, stone, metal, dimensions, or other specifications.

Gemstones, diamonds, and other specially sourced materials are subject to availability. A quotation or proposal does not guarantee availability of a particular stone or material until the required payment or deposit has been received and the order has been confirmed.

Applicable taxes, shipping, or other charges will be shown or communicated when applicable.

Order Acceptance

Submitting an order or payment does not necessarily constitute final acceptance of an order by Ela Atelier.

We reserve the right to cancel or decline an order due to pricing or listing errors, product or stone availability, suspected fraudulent activity, inability to complete the requested design, or other reasonable circumstances.

If Ela Atelier cancels an order that has already been paid and production has not been completed, any applicable amount paid for the canceled portion will be refunded.

Production Timelines

Production and delivery timelines provided by Ela Atelier are estimates.

Custom and made-to-order jewelry may require additional time for sourcing, manufacturing, quality control, or other production requirements. Delays may also occur due to shipping carriers, holidays, supplier delays, or circumstances outside our reasonable control.

If you require a piece for a wedding, event, or specific date, please communicate your deadline before placing your order. A requested date is not guaranteed unless expressly confirmed by Ela Atelier.

Shipping & Delivery

Customers are responsible for providing complete and accurate shipping information.

Ela Atelier is not responsible for delays caused by shipping carriers or incorrect information provided by the customer.

Returns & Refunds

All sales are subject to our Return & Refund Policy.

Because many Ela Atelier pieces are custom or made specifically for the client, purchases are generally final sale and are not eligible for return, refund, or exchange except as otherwise required by applicable law or expressly agreed to by Ela Atelier.

Sizing & Customer-Provided Information

Customers are responsible for confirming the accuracy of ring sizes, chain lengths, bracelet measurements, engraving details, shipping information, and other specifications submitted for an order.

Changes or alterations resulting from incorrect information supplied by the customer may be subject to additional charges.

Jewelry Care & Repairs

Jewelry naturally experiences wear over time. Scratches, worn finishes, damaged or bent prongs, loose stones resulting from impact, broken chains, and damage caused by improper care are not considered manufacturing defects.

Any repair, alteration, resizing, or modification performed by a third party may affect Ela Atelier’s ability to provide complimentary service or address a manufacturing-related issue.

Intellectual Property

All original Ela Atelier content—including custom designs, CADs, sketches, renderings, photographs, graphics, logos, website content, and other creative materials—is owned by or licensed to Ela Atelier and may not be copied, reproduced, distributed, manufactured, or commercially used without permission.

Payment for a CAD or custom design service does not transfer ownership of Ela Atelier’s underlying design or intellectual property unless otherwise agreed to in writing.

Website Use

You agree not to misuse our website, attempt to interfere with its operation, engage in fraudulent activity, copy or commercially exploit its content without authorization, or use the website for unlawful purposes.

We may modify, suspend, or discontinue portions of the website or our services when reasonably necessary.

Privacy

Your use of our website and services is also subject to our Privacy Policy, which explains how Ela Atelier collects, uses, and protects personal information.

Limitation of Liability

To the extent permitted by applicable law, Ela Atelier will not be responsible for indirect, incidental, or consequential damages arising from the use of our website, products, or services.

Nothing in these Terms is intended to limit any rights or remedies that cannot legally be limited or waived under applicable law.

Orders will remain subject to the terms applicable at the time the order was placed, except where a change is required by applicable law.

These Terms of Service are governed by the applicable laws of Puerto Rico and the United States, without limiting any consumer rights provided by applicable law.
